| Employment Cases Increase Our employment law practice
continues to be quite active as many brokerage firms restructured and consolidated after
mergers and acquisitions.
Many
brokerage firm employees have been dismissed, offered severance packages or reassigned to
new positions. The firm has been called upon to advise numerous clients with regard to the
new employment contracts or severance packages they were being offered.
We also
represented individuals who were promised but did not receive certain compensation. In
several of the cases, Gard Smiley represented brokers who were promised year-end bonuses,
but who were terminated and never compensated. Such cases often fare well in arbitration.
As in the
past, we continue to pursue claims for individuals arising out of workplace discrimination
and sexual harassment. Employment litigation of this type has increased during recent
years and is expected to continue to increase during the foreseeable future.
The firm
also continues to handle claims against employers for wrongful termination, intentional
interference with business relationships, defamation, and large front-end bonuses
structured as forgivable loans.
